General data protection policy of FoodChain ID in France

In accordance with our philosophy, the protection of your personal data is important to us and we would like to inform you through this general data protection policy (“Data Protection Policy”) about how we collect and process your personal data.

GLOSSARY

In the Privacy Policy, unless otherwise specified, the following words and phrases have the respective meanings set forth below:

Intermediate Archiving: means the isolation by logical separation (management of access rights and authorizations limited to a specific service) and/or physical separation of Personal Data that is still of administrative interest to FoodChain ID.

CNIL: means the French National Commission for Information Technology and Civil Liberties.

Personal Data: any information relating directly or indirectly to you as a natural person.

Entity: entity of FoodChain ID with which you have subscribed/are considering subscribing a Product and/or Service and which implements Data Processing concerning you.

Products: documentary or informative products, in particular books, publications, fact sheets, updates, in paper or digital format published or distributed by FoodChain ID.

Regulation: means Law n°78-17 of January 6, 1978 relating to data processing, files and freedoms as amended, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as “RGPD”) as well as any regulation in force concerning the protection of Personal Data.

Services: professional training, consulting and support services, software solutions, any documentary service by telephone, service offering access to community spaces, content services related to employment.

Site: refers to the Internet sites published by FoodChain ID.

Terminal: means the hardware equipment (computer, tablet, smartphone, telephone) that you use to consult or view the Site.

Processing: refers to the collection, recording, organization, structuring, conservation, adaptation or modification, extraction, consultation, use or any other form of provision, reconciliation or interconnection, limitation, deletion and destruction.

1. Scope of the Privacy Policy

The Privacy Policy applies to all Sites, Products and Services published and distributed by FoodChain ID.

Consequently, the use of a Site or the subscription to Products and Services published and distributed by FoodChain ID implies that you have accepted all the terms of the Policy on the protection of personal data, and therefore the collection, use and transfer of Personal Data concerning you.

2. Actors of the protection of personal data within FoodChain ID

The Entity is the data controller for the Processing that it implements on the Products and Services.

3. Nature of the Personal Data collected by FoodChain ID

FoodChain ID takes into account the principles of data minimization, data protection by design and data protection by default. Consequently, information is collected that is relevant, adequate and limited to what is necessary for the purposes for which it is processed.

3.1. Personal data collected

FoodChain ID collects and processes, in particular, your surname, first name, your position within the organization and the department to which you are attached, your professional telephone number, your professional e-mail address and, for community spaces and services related to employment, your personal or professional contact details, depending on your choice, as well as your CV if you so wish.

FoodChain ID will not collect Personal Data without having informed you in advance of the use that will be made of it.

Furthermore, cookies, i.e. small text files that record certain information in order to facilitate your browsing experience, are deposited on your Terminal when you browse the Site.

Subject to the settings on your Terminal, FoodChain ID uses the following Cookies:

Browsing cookies: these are cookies that are necessary for browsing the Sites. These Cookies enable FoodChain ID to ensure the proper functioning of the Sites.
Functionality Cookies: These are Cookies that allow us to keep a record of your preferences and chosen parameters in order to ensure a fluid user experience. For example, they allow you to access your personal areas on the Sites directly without having to enter your connection parameters several times or to store purchases in the shopping cart.

Subject to your agreement, FoodChain ID may deposit the following Cookies:

Audience measurement cookies: these are cookies that allow us to follow your navigation in order to establish consultation statistics and monitor the performance of the Sites and each of their pages. These cookies allow us to improve our services in order to provide a better user experience.
Targeting/Advertising Cookies: These are Cookies that allow us to offer content and advertisements adapted to your needs, taking into account your preferences and your last purchases.

This Personal Data is collected when:

You fill in online forms;
You upload content online;
You create or modify your customer account in the dedicated space on one of the Sites;
You pay for an order or a subscription;
You browse one of the Sites;
You contact FoodChain ID customer service;
You download a white paper or any documentation related to one of our Products and/or Services;
You request a demonstration of a Product and/or Service or a quote;
You participate in an event, a conference or a webinar;
You register to a community site;
You apply for a job offer.

3.2. Use of Cookies

Any settings you may make may affect your ability to browse the Internet and access certain services that require the use of cookies.

3.2.1. Agreement on Cookies

You do not expose yourself to any risk by accepting the use of this system. Cookies do not damage your computer.

The storage of a cookie in a terminal is essentially subject to your consent. You can express and modify your choices at any time and free of charge in the navigation software of your Terminal.

If you have accepted the recording of Cookies in your browser software, the Cookies integrated into the pages and contents that you have consulted may be stored temporarily – without being able to exceed thirteen (13) months – in a dedicated space in your Terminal. They will be readable only by their issuer.

3.2.2. Refusing Cookies

If you refuse the recording of Cookies, or if you delete those which are recorded, you will no longer be able to benefit from a certain number of functionalities which are nevertheless necessary to navigate in certain areas of our Site (if you try to access our content or services which require you to be identified).

If necessary, we decline all responsibility for the consequences related to the degraded functioning of our Services resulting from the impossibility for us to record or consult the Cookies necessary for their functioning and which you would have refused or deleted.

4. Purposes of Processing

4.1. On the basis of a contract or pre-contractual measures:

The Entity carries out operations relating to the management of pre-contractual relations and in particular:

The sending of quotes,
Making appointments and
Free trials.

The Entity carries out operations relating to the management of commercial relations and in particular:

The conclusion, management, supply, delivery and invoicing of the Products and/or Services subscribed to,
The follow-up of the customer relationship,
The accounting,
The management of complaints, payment incidents or unpaid bills, and
The management of your requests for access, rectification, opposition, deletion, limitation and portability of Personal Data.

4.2. On the basis of the legitimate interest of FoodChain ID: the Entity carries out the following Processing operations:

Characterization of customer profiles and analysis of your purchasing preferences;
Improvement of our Products and Services by inviting you to participate in satisfaction surveys;
Training of FoodChain ID staff;
Elaboration of analytical studies and commercial statistics;
Exercise or defense of a right in court;
Sending commercial or promotional solicitations relating to the Products and Services of the Entity. At any time, you may object, free of charge, to your Personal Data being used for prospecting purposes, without having to give reasons for this request, by sending your request to FoodChain ID through our dedicated portal. FoodChain ID draws your attention to the fact that exercising the right to object does not prevent the Entity from continuing to contact you for other purposes, in particular by virtue of a legal obligation or for the execution of the contract.
Improving the relevance of the information sent.

4.3. On the basis of your express consent: the Entity carries out the following Processing operations:

Subscription to newsletters or web conferences offered by FoodChain ID,
Registration to a community site,
Transmission of applications to a potential employer,
Downloading of content,
Requests for information on the Products and Services published and distributed by FoodChain ID,
Registration to contests,
Exchange of your Personal Data to our partners and to FoodChain ID entities with which you have not subscribed to any Products and Services in order to inform you about products and services that may be of interest to you (by mail, telephone and e-mail).

In this context, you may withdraw your consent at any time, without this withdrawal affecting the lawfulness of the Processing carried out by FoodChain ID prior to said withdrawal. FoodChain ID may also use your Personal Data for administrative purposes or for any other purpose imposed by the Regulations. You are informed of the existence of the “Bloctel” list of opposition to telephone canvassing, on which you can register here: Bloctel portal.

5. Duration of storage of Personal Data

Your identification data is kept for commercial prospecting purposes for a maximum of three (3) years from the date of the last service / product delivery or the last “active” contact with the Entity (example of active contact: the opening of a link (click) from an email).

In the particular case of community spaces, personal data is kept for the entire duration of the member’s account and for a maximum period of one year after the closure of the account.

In the event of litigation, of any nature whatsoever, for example against the administration, your Personal Data as well as all information, documents and papers containing Personal Data may be kept for the duration of the proceedings, including for a period longer than those indicated above.

The other data, and in particular those related to your orders, are subject to Intermediate Archiving for the legal or regulatory prescription periods.

FoodChain ID undertakes to delete the Personal Data from its databases at the end of this period or to make them anonymous.

In addition, your Personal Data collected via Cookies are only kept for a period of thirteen (13) months from the date of collection of such Data.

6. Recipients of your Personal Data

FoodChain ID never transmits your Personal Data to third parties likely to use them for their own purposes and in particular for commercial purposes and/or direct advertising, without your express consent.

The Entity may share your Personal Data, only to the extent necessary, with

Its employees authorized to process your Personal Data;
The other FoodChain ID Entities with which you have previously subscribed to a Product and/or Service: You are informed that such an Entity may contact you, in particular for commercial prospecting purposes, by a means of communication (email / telephone) collected by another Entity.
The other FoodChain ID entities with which you have not subscribed to the Product and/or Service and their collaborators: The FoodChain ID entity with which you have subscribed to the Product and/or Service may be required to share your Personal Data in a secure manner with the other FoodChain ID entities within the framework of the operation of the Products and Services, in particular for logistical purposes and, if you have agreed, for commercial prospecting purposes;
Its service providers and contractually bound subcontractors for the performance of tasks relating to the purposes described above;
Organizations in charge of carrying out surveys or polls;
Public authorities: the Entity may be obliged to communicate your Personal Data in response to a specific request made by a competent administrative or judicial authority, as well as more generally in all situations where the law, regulations or an administrative or judicial decision requires it.
Other third parties: If you have expressly consented, we will provide your Personal Data to carefully selected third parties, including partners for the marketing of services that may be of interest to you, or to third parties for whom you have subscribed or accepted a service from us.

In addition, in the event of a reorganization, merger, sale, joint venture or other transfer or assignment of all or part of our business, we may disclose or transfer your Personal Data to the transferee.

7. Storage of your Personal Information

Your Personal Data is stored either in the databases of FoodChain ID or in those of service providers and subcontractors contractually linked to FoodChain ID, which are located within the European Union.

8. Security of Personal Data

FoodChain ID undertakes, within the framework of its activities and in accordance with the Regulations, to ensure the protection, confidentiality and security of Personal Data.

FoodChain ID takes the necessary precautions taking into account the state of knowledge, the costs of implementation and the nature, the scope, the context and the purposes of the Processing as well as the probability of each risk in order to preserve the security and confidentiality of the Personal Data that you communicate to it and in particular to prevent them from being deformed, damaged or communicated to third parties (except with your consent).

Consequently, FoodChain ID implements all technical, logical, physical and organizational measures to ensure a level of security appropriate to the risk and to prevent any loss, alteration, disclosure of Personal Data or access by unauthorized third parties.

However, due to the inherent characteristics of the Internet, any transmission of information over the Internet is not completely secure. The Personal Data transmitted to FoodChain ID are subject to measures that cannot protect against all risks of detour and/or piracy. FoodChain ID cannot guarantee the protection of your Personal Data from the risks inherent to this context.

In case of violation of Personal Data and in accordance with the Regulations, FoodChain ID undertakes to notify the CNIL.

9. Transfer of Personal Data

The Data collected by FoodChain ID may, within the framework of the above-mentioned purposes, be transferred to a country outside the European Union which has been the subject of an adequacy decision by the European Commission, only to American companies that are self-certified under the Privacy Shield agreement and that have been previously registered on the register held by the American administration for this purpose, as well as to a country outside the European Union that is not subject to an adequacy decision by the European Commission, provided that appropriate safeguards are in place in accordance with the RGPD.

10. Your rights

In accordance with the Regulation, you have:

A right of access: the right to question the Entity to know if it holds Personal Data about you and to ask to know them.
A right of rectification: right to ask the Entity holding Personal Data about you to rectify them in case of errors or inaccuracies.
A right of opposition: right to refuse, for legitimate reasons, to appear in a file, except for commercial prospecting where the motivation is not required.
Rights relating to digital death: the right to define general or specific directives relating to the conservation, deletion and communication of your Personal Data after your death, which may be registered with a trusted digital third party certified by the CNIL. These directives may designate a person responsible for their execution; failing that, your heirs will be designated.
A right to limitation of processing: the right to request that certain Personal Data not be retained for future Processing.
A right to erasure: in cases covered by the Regulation, the right to obtain the erasure of Personal Data.
A right to the portability of your Personal Data: right to obtain, if necessary, from FoodChain ID the transmission of its Data to another controller.

You can exercise your rights by sending your request to FoodChain ID through our dedicated portal.

You may also bring an action before the competent courts, without prejudice to your right to submit a complaint to the Commission Nationale de l’Informatique et des Libertés, if you consider yourself to be a victim of a violation of the regulations relating to the protection of Personal Data.

11. Modification of our Policy on the protection of personal data

We reserve the right to modify our Privacy Policy. Any changes will be posted on the Site. Any use of the Site after the date of the change will be deemed to be your unconditional acceptance of the new Privacy Policy.
